Durable Power of Attorney
An important but often overlooked estate planning tool is the Durable Power of Attorney in which you designate someone you trust to handle your legal affairs during your lifetime. Plan ahead. POA’s are often needed when someone becomes unable to handle their own affairs and the POA names a primary and a second agent to manage their legal affairs.
We recommend a broad range of powers and recommend a backup in the event the first person designated is unable or unwilling to perform the duties. It is essential that everyone understands that the POA is a fiduciary duty, and the person serving in that capacity can act only for the best interests of the person for whom they have the POA.
